Surrogate Motherhood

Surrogate motherhood is an attendant reproductive process (ARP) providing for the transfer of embryos produced as a result of puncture and fertilization of oocytes into the uterine cavity of a woman having no genetic relationship to such embryos, with the purpose of their further implantation, development and childbirth.

Order No. 787, p. 6 of the Ministry of Health of Ukraine “About Approval of Procedure of Application of Attendant Reproductive Processes in Ukraine” expressly specifies all standard regulations for the use of surrogacy services as an attendant reproductive method for infertility treatment purposes.

Application of a surrogacy program is subject to the following essential conditions:
  • presence of medical indications;
  • availability of proper documents;
  • a family couple or one of the would-be parents in whose interests surrogacy services are to be provided must be genetically related to a child who will be born;
  • a surrogate mother must not be genetically related to a child.

Indications to Surrogacy Program
  • inborn or acquired absence of uterus;
  • deformity of uterine cavity or neck as a result of inborn development defects, surgical interference, benign tumors;
  • structural-and-morphological or anatomical endometrium changes, resulting in loss of receptivity, synechia (commissural process) in uterine cavity;
  • grave somatic diseases affecting the pregnancy carrying process and jeopardize health and life of recipient and child;
  • recurrent failed IVF attempts.
An adult, legally capable woman can be a surrogate mother, provided she has her own genetically-related healthy child. Prior to the embryo transfer procedure, the woman must give her written consent to participation in the program and pass comprehensive medical examination. If no medical contraindications are found, the doctor begins getting her body ready for embryo transfer.

Algorithm of application of attendant reproductive process with use of surrogacy method:
  • selection of surrogate mother;
  • synchronization of menstrual cycles of recipient (customer or oocyte donor) and surrogate mother, preparation embryos for transfer;
  • transfer of embryos into uterine cavity of surrogate mother;
  • diagnostics, maintenance of pregnancy, and delivery.
Pursuant to Article 123 of the “Family Code of Ukraine” a surrogate mother, after having given birth to a child, shall not have any rights in respect of such a child. Following the delivery, no contacts between the surrogate mother and the child may be allowed.

List of documents that must be provided by surrogate mother to take part in surrogacy program
  • written consent to participation in surrogacy program;
  • passport copy;
  • copy of marriage or divorce certificate (except for women who have never been married);
  • copy of child (children) birth certificate(s);
  • should a surrogate mother be formally married, her husband’s notarized consent to participation of his wife in the program would be provided.

List of documents that must be provided by customers to fulfill surrogacy program
  • written consent to application of attendant reproductive processes;
  • passport copy;
  • notarized copy of general contract between surrogate mother and woman (man) or family couple.
